DATA PRIVACY, SECURITY & AI TRACK: The Changing Landscape of Data Privacy
Evolving technology and increasingly sophisticated methods of data collection have led state and federal lawmakers to focus on how consumer data is collected and used. Industry participants must react to the myriad of rapid technological and regulatory changes. The panel discusses recent changes to the state privacy laws and the CFPB’s Open Banking Rulemaking.

Gabriel Acosta is the Regulatory Specialist in the Residential Public Policy and Industry Relations department at the Mortgage Bankers Association. Gabriel works with the team to analyze agency actions and legislation in areas related to origination, servicing, and data protection. Gabriel also works with member committees to provide guidance to members on the changing regulatory landscape. Before the Mortgage Bankers Association, Gabriel previously worked in Congress on criminal justice and immigration issues. Gabriel is a recent graduate from the Georgetown University Law Center and was a student at Georgetown’s Federal Legislation Clinic.

Ted Augustinos advises clients in various industries on privacy and data protection, cybersecurity compliance and incident preparedness, and breach response. He is a member of the Steering Committee of the Firm’s Privacy and Cybersecurity Practice Group, and leads the group's initiatives focused on the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), and New York DFS Cybersecurity Regulation, and its Incident Response Team. He is a Certified Information Privacy Professional, accredited by the International Association of Privacy Professionals. Ted serves as Co-Chair of the World Law Group’s Data Protection and Privacy Group, and as Managing Partner of the Hartford, Connecticut office of Locke Lord.
Amanda Lawrence partners with financial services companies, including fintechs and traditional financial institutions, in a wide range of consumer litigation, enforcement and regulatory matters. From reviewing and establishing compliance programs, to providing regulatory advice, to defending against government enforcement actions and commercial complaints, Amanda’s full-service practice works to secure the client’s future. She is a trusted adviser to and first call in high-stakes litigation and enforcement matters, including government investigations, regulatory examinations, class action and complex litigation, and internal investigations. Her matters include investigations, examinations, and enforcement actions before the CFPB, FTC, federal and state bank regulators and state attorneys general, including defending a leading bank in one of the CFPB’s first enforcement actions—a joint investigation and enforcement action with the FDIC.
Ashley L. Shively is a privacy attorney and class action litigator in Holland and Knight's San Francisco office. Ms. Shively counsels public and private companies on consumer protection and data privacy issues with respect to product development, sign-up and point-of-sale procedures, auto-renewals and subscription products, digital marketing, regulatory compliance, incident response, and state and federal enforcement. She regularly advises clients on operationalizing the requirements of the California Consumer Privacy Act (CCPA/CPRA), Colorado Privacy Act (CPA), Virginia Consumer Data Protection Act (VCDPA) and analogous state privacy statues and legislation. In addition, Ms. Shively counsels businesses on risk mitigation with respect to the California Invasion of Privacy Act (CIPA), Video Privacy Protection Act (VPPA), Drivers Privacy Protection Act (DPPA), Children's Online Privacy Protection Act (COPPA), Controlling the Assault of Non-Solicited Pornography and Marketing (CAN-SPAM) Act of 2003, Telephone Consumer Protection Act (TCPA), state privacy and unfair and deceptive practices laws, and similar legal and regulatory requirements.
