Servicing governing documents include written agreements between a lender/investor and a servicer that stipulate various rights, obligations, requirements, and duties of the servicer. Governing documents include servicing contracts and agreements structured in a variety of formats and levels of detail. Although most servicing governing documents, including contracts, agreements, and guides address the same core servicer activities, the requirements and conditions that the servicer must adhere to may vary, particularly depending on the type of transaction (CMBS, GSE, agency, or portfolio).
Commercial/Multifamily Servicing Governing Documents Fundamentals explores the basic concepts of the various servicing contracts, agreements, and guides across CMBS, GSE, agency, and portfolio lending transactions. First, the course discusses the basic characteristics and types of commercial/multifamily mortgage loan servicing governing documents. Next, the course explores how servicing governing documents typically cover servicer-initiated activities, such as payment collection, escrows, etc. The course then covers the manner in which servicing governing documents address typical borrower requests. Finally, it talks about the transferability of servicing governing documents in servicing transfer situations.
